1/7: Sheree Whitfield appeals divorce to Ga. Supreme Court

On the show “The Real Housewives of Atlanta,” Sheree Whitfield expressed a desire for a “seven figure” settlement from her ex-husband and former Falcon player Bob Whitfield. She has since said very little about the case because of legal wranglings.
She received a settlement last year but wasn’t happy with it. So she has appealed it all the way to the Georgia Supreme Court. The case is scheduled to be heard Monday, January 12.
Her attorneys painted her a high school graduate with limited skills to earn income, arguments for alimony she did not receive. This agreement meant she wouldn’t be able to stay at her $2.6 million home. She receives $113,422 a year from the divorce, not enough for her live the lifestyle she’s used to and clearly not at the level of what the hit Bravo show conveys. Sheree also received a lump sum of $775,000, shares of Whitfield’s retirement pension, nearly half of the marital property and child support.
Here are all the facts provided by the Georgia Supreme Court public information officer:
The ex-wife of a former Atlanta Falcons football player is appealing a Fulton County court’s refusal to grant her alimony and a new trial. Under a 2003 pilot project, the high court has agreed to review all challenges to final divorce decrees that are not deemed frivolous.
FACTS: Bob and Sheree Whitfield separated after three years of marriage in 2003 and divorced after seven in 2007. They have two children, who were 8 and 11 at the time of the divorce.
Bob Whitfield, 36, is a recently retired NFL player who once played for the Atlanta Falcons. Sheree Whitfield currently appears on the popular reality TV show, “Real Housewives of Atlanta.”
The trial court awarded her custody of the children and $2,142.87 a month in child support. It also awarded her a division of the marital property totaling more than $1.1 million and including a lump sum payment of $775,000. It gave her half of the marital portion of three NFL retirement plans. But the court did not award alimony.
The court awarded him nearly all the real estate, including four homes, and the recording studio, Patchwerks, which he founded. Her lawyers moved for a new trial over the denial of alimony. The lower court denied the motion, and she now appeals to the Supreme Court.
ARGUMENTS:
Her attorneys argue that based on her lack of education and inability to earn income, the court abused its discretion by not awarding alimony and then ordering her and the children out of their $2.6 million home in Sandy Springs.
Under state law, the trial court must consider a number of factors in determining the amount of alimony, including the standard of living established during the marriage, the duration of the marriage, the financial resources of each party and the time necessary for a party to acquire sufficient education and training to get a job.
Her ex-husband not only received an $8 million signing bonus as part of a $30 million six-year contract, but he is also a sophisticated businessman with investment properties in Costa Rica, California and Atlanta, as well as founder and owner of a “world-class” recording studio, from which he draws $50,000 annually.
To enhance his earning power, he has returned to Stanford University. She, on the other hand, has devoted her time to raising the couple’s two young children. The clothing boutique she managed for a brief time, “Bella Azul,” quickly failed under her management and oversight, her attorneys point out. With only a high school degree, she depended on her husband, with whom she had been in a relationship for 14 years.
Despite her lack of education, marketable job skills and employment prospects, the court wrongly denied her alimony, even though her husband’s monthly income is almost 12 times her. The failure to award alimony is also contrary to the best interests of the children, her attorneys contend. Without alimony, she cannot afford to buy another home in the neighborhood where they have grown up, have friends and go to school.
His attorney argues that even though the marriage was “very short-term,” she was awarded 48 percent of the marital estate and a part of three retirement plans. Alimony is authorized but not required under state law, and the trial court did not abuse its discretion by not awarding any to her.
“The trial court left no stone unturned in regard to determining the assets and incomes of the parties,” his lawyer argues in the briefs. From the divorce, she receives a total yearly income of $113,422. In addition, she gets a portion of three NFL retirement programs. His attorney argues she should be fined $2,500 for bringing a frivolous appeal solely for the purpose of delaying the time when she’ll have to vacate the Sandy Springs home.

I’m ok with the fact that she only had a high school diploma initially, but when you have a man making millions you should use your time with him and the available resources to your advantage. Wow! Wish I could earn 113K per year and have a part in THREE retirement plans and not have to do anything constructive with my life. Good luck in actually winning this case. The state supreme court doesn’t usually overturn these types of decisions. Poor thing, won’t be able to spend super lavishly, but still more than the average real housewife in Atlanta.

Ladies take note, this is what happens when you don’t go to college or otherwise prepare yourself to take care of yourself. You go around begging a man for his money and relying on the court system to provide you with a roof over your head. Now I’m not saying he shouldn’t provide for his children, but it seems that the divorce has devolved into a p** match between a woman who wants to live beyond her means and a man who will spite himself to keep his hard-earned money away from her. Was there no prenup? I just can’t comprehend him marrying her without a prenup. And during the 14 years that they dated why didn’t she go to school and learn a skill?

This had to be the most demeaning divorce document I’ve come across in a minute. This woman is begging for cash she did not earn? Then she clearly is “ok” with HER own lawyers calling her uneducated with no skills? Are you serious? Is she that desperate. The information on the settlement leaves some questions. If he was given almost all of the real estate including four homes, what property did she receive?
It said division of marital property(assets?) of $1.1 million and a $775k lump sum. Was the $775K included in the 1.1 million or was it separate?
Like many have already mentioned, she never planned on having to do anything other than be an NFL wife.
I wonder how much of the lump sum is left? She can certainly get a degree and with the lump sum and $113k she annually receives, those kids will have a solid upper middle class existence.

Now, there is no excuse why Sheree cannot be proactive, employed, and education can be on going if she is to support herself and children. She got monies from the onset; lost her business perhaps with the money she got. Now, we are not stupid, she want’s to pretend that she cannot work or support herself; I have not seen a woman that can’t, in fact, they do a better job then men supporting themselves. Sheree really needs to think this over again and again. First, of all kids are not shown value of relationships, friendship through money, but that is what she is teaching them. Sheree really needs to be ashamed of herself for letting someone else deminish her or her lack of knowledge, she has had the opportunity to educate herself but chose not too. If she were awarded the alimony she has admitted to the court that she does not have the knowledge to handle the additional money. She is using this to buy time in the house. Now, I know I heard her on the radio that she was “interviewing” for a personal assistant, when she needs to “interview” for a good CPA firm and hire a tutor so she can educate herself and teach her kids especially her daughter to provide for themselves and don’t let a man define you………because that is exactly what she is doing, letting a man define her.

I’m confused. She said on the show she was 38 and from an upper middle class family. This must have been a fabrication. Most children in upper middle class families are encouraged by their parents to go to college and obtain a degree, because they have the financial means to cover it and they know the value of a degree. Why did she not take advantage of that 20 years ago, if what she said is true, and therefore not be subject to this embarrassment?

This is ridiculous! I didn’t even know she had children, and if so where the hell were they during the show??? Oh, yeah, there was one she had sitting in the kitchen waiting to be picked up on one episode, like she was the neighbor’s kid! All these women are disgusting I really wish Bravo would have taken their time in finding some “REAL” real housewives of ATL, not a bunch of broke B’s that wanna try and act like what they saw on housewives of Orange Co., and New York! Leave the woman alone, she is doing her thing and if having a high school diploma is all she wants then that’s her business, I’m sure there’s more to this story and the 14 years she’s been with him. After reading these blogs, I have to make a comment about this situation. We are so quick to judge people, that is God job. Let God deal with Sheree. That old saying, “what goes around, comes around.” KARMA!!! We have better things to deal with, college students graduating and needing jobs, people who became homeless due to the ecomony, and people who are trying to do something with their lives. There is so much hatred in this world, when are we going to change???
Let spend the energy we us on negative, and help upbring the positive back in our country.

Stop being so dependent upon a man and always using ur looks to be your meal ticket. Get a job, a skill, some self reliance or something! She should be fine. Sad that she allowed her attorneys to paint her in such a bad light, and even sadder that they (her attorneys) will probably get most of her lump sum for their services.

I know the Whitfields personally. I have sat in their living room and ate their food. I know the kids and the nanny and the “wife”. She was and is a bad wife. She was a biatch thru and thru. Bob was not perfect, but she was a pain. She got the huge 4.4 mil house in ATL which was the most expensive and best property. She needs to put it up for sale and use that money to make something for herself. the settlement was more than fair. The Kids could have gotten more in a trust fund or something like that, but she doesn’t deserve anything more.

OMG!!!! What an embarrassment. I use to feel bad that I was 40 and had never been married with one child, but I feel pretty damn GOOD after reading this BS!!!! I may be single, old, with one child, but I have a bachelors degree, numerous certificates, work two jobs to put my daughter through private school, orchestra, and tennis. We don’t have much but we sure are happy with what we do have, thank GOD!!!! She is OVER THE TOP!!!!

For those who keep saying PRENUPTIAL Agreement. Remember, prenups are mainly put in place for the protection of the party who has the most money/assets. Halle Berry had a prenup with Eric Benet but not with David Justice (she learned her lesson during the 1st marriage to protect herself). Who is to say that a prenup was discussed early on and refused by Sheree because of what the document stated! And for the bible thumpers about judging? Please stop! I am Christian too and I have opinions. Anyone can voice their opinion at anytime. Our opinions are based on the document above, the show, and basic common sense. On my show and in my column, I tell folks all the time to EXPRESS their opinions. Sheree is a piece of work. (I wrote my opinion above already). Notice that some of you agree with me about her lying about her “upper middle class” upbringing because of her no college education. Also, let me add that no one is saying that we are all doing better than Sheree. I believe, again, we are commenting on what is written. THe difference is that we did not sign up for a show or create a blog that tells all of our business. When you are a public figure, this is all part of the game. Sheree wanted the attention, she doesn’t get to say what TYPE of attention. Oh, and Lisa was married to Keith Sweat before - her current husband is Ed Hartwell (this is for the person who mistakenly said that Lisa doesn’t ask Ed for a handout, I think you meant Keith). And the lump sum is part of the total 1.1 million (it says so in the document- more than $1.1 million and including a lump sum payment of $775,000). Including means it was included. Total is the total. Sheree and Kim should move in together - this would make for interesting tv! Entertaining!

I think there should have been more money given to her for child support. $2,000 per month is really not a lot for two children considering his yearly income is very high.

JUST WHEN I THOUGHT WE MADE MAJOR STEPS FORWARD……….HERE COMES SHEREE, If Sheree, really knew how this makes her look she would think twice about her decision on her strategy for getting alimony. This is sad, she is consistantly putting her children in the forefront as they need to live close to their friends and stay in that house. Okay, see she is teaching her kids nothing about relationships / true real friendships, she is showing them monetary friendships like Sheree has. How on one hand you are going to say you only have a high school education but on the other hand ask for more money……okay seems to me that a judge would think you don’t know how to handle that money wisely because you put limitation’s on yourself by stating that “ON PAPER”. Please, you were on the radio saying you were “interviewing” for a personal assistant when you need to be “interviewing” for a good CPA firm” and “interviewing” for a tutor so you can learn how to handle your money and business and teach your kids how to ‘EARN’ a living on their own and don’t let a “MAN or LIFESTYLE” define you, because that is exactly what you exploit. Even on the show all you did was “act” like you had it going on and use your pinky finger to pull your hair away from your face.
Take a look at Lisa Wu Hartwell, Business mind, business style, business appeal, and knows how to speak well in front of business people.
With just your high school diploma - since that’s how you put your limitation, can you spell….FAKE, if not, I just spelled it for you so look it up and see if your picture is next to the word as the definition…….SAD JUST PLAIN SAD…….

If he is the one that chose to leave the marriage, then he should pay to keep her and his children in the lifestyle they had grown accustom to. If it was her decision to leave the marriage then she should be happy with what she got. Most of you want to judge when all you have seen is the trash. Anyone who has ever been through a divorce knows, it doesn’t all get put in the papers. You don’t know the whole story. You want to judge based on what you see when producers cut the film; knowing full well that they make them out to be more shallow than they really are.

Why is the Supreme Court wasting time and $$$ to hear this BS? I hope Bob’s attorney limited the $$ to 3 years since that is how long they were married. As far as Child Support, it is tax free and sounds a little low. Been through this myself and made a lot less than Bob but had to pay $3,500.00 a month in child support for 2 kids. Men get screwed in a divorce but should always take care of the kids.
BTW-I don’t believe anyone owes their spouse a lifestyle.

wont throw stones, look at women like Tracey Edmonds, Kimora Lee Simmons, etc. They didn’t sit back and do nothing while they were married to wealthy, powerful men. THey parlayed those relationships into vibrant, successful businesses. No matter how much disagreement there is or was between Russell and Kimora, he respects her as a business woman. She busts her butt everyday to bring that paper home. So please don’t tell me that all of us would do the same. No, honey, most of us would have prepared for the future. I think Sheree needs a shrink to work through her lack of self-worth, and then she will understand that she deserves better from HERSELF.

REALITY CHECK TIME FOLKS Pro ball players PICK pretty and shining women ONLY. Not necessarily the average and educated women are sought after in this realm. Bob Whitfield had a heck of lawyer her. Probably made arrangement for the legal staff to free VIP tix and seats at the football games. Works everytime. Carefully review the facts. Sheree - she got screwed and I would challenge the ruling too. Yes Sheree should continue to source and find her entrepreneur nitch. And yes get a business degree to run her business with integrity. If you all read the findings in Lisa Wu divorce from Keith Sweat she also got ROYALLY screwed. And she lost her children. My point is it all relates to how these divorce cases are handled and the women and children are usually victimized.
My point is the courts and most people are quick to blame the women and call them gold diggers when in essence getting married and having babies ALWAYS TAKES TWO! Even when the guy, athlete, celebrity cries TRICKED AGAIN I say IT TOOK TWO.
Sheree role on the Real Housewives of Atlanta is purely entertainment. Sure personality may prevail but confidence can be pumped by money and fame. Sheree get your money and return some of the shoes. This winter could be cold.

If I were Bob, from the goodness of my heart, I’d pay her tuition to the Atlanta Institute of Art to study “fashion”. If she wants to be in the industry, go learn the trade. That way she’ll get a higher education and has the ability to become a wage earner. I wouldn’t give her any additional money to pocket.
On second thought maybe Bob should sue her for custody of the children and ask her to pay him alimony!

For someone with an education no further than high school, I think she has come out wonderfully. She is greedy. She has had ample time to further her education and be a wonderful mother. I don’t have anywhere near her resources and I’ve managed to raise two children on my own and go back to school after my divorce from their father and received two degrees. Be happy with what you have. It could have been worse.
